The National Commission for Refugees and Stateless Persons is the government body responsible for the management of refugees and stateless persons in Benin. It works on the basis of Law 2022-31 of December 20, 2022 on the status of refugees and stateless persons in the Republic of Benin, the 1951 Geneva International Conventions on the Status of Refugees, the 1967 New York Protocol and the 1969 OAU Convention Governing the Specific Aspects of Refugee Problems in Africa. In addition to these Conventions ratified by Benin, there is the 1954 Convention relating to the Status of Stateless Persons and the 1961 Convention on the Reduction of Statelessness. It is placed under the supervision of the Ministry of the Interior and Public Security. This structure, chaired by the Minister of the Interior and Public Security, is composed of nine (09) members representing nine (09) ministries, a permanent secretariat which constitutes its executive body and two deliberative bodies. The Director of the Beninese Civil Protection Agency (ABPC) is the Permanent Secretary, responsible for the daily administration of said secretariat. The SP-CNRA is governed by Decree No. 2024-1362 of November 20, 2024 on the attribution, composition, organization and functioning of the National Commission for Refugees and Stateless Persons. In Benin, the UNHCR Representation ensures, in collaboration with government authorities, the respect and promotion of the rights of refugees and stateless persons. In this effort, legal provisions require the improvement of the quality of the refugee status determination system and the establishment of procedures for determining stateless status. This law not only specifies the obligations of the Beninese State towards asylum seekers, applicants for stateless person status, refugees and stateless persons but also explains the procedures to be applied for the recognition of refugee and stateless person status.
